§ 2-63. Code enforcement officer; duties.

  • (a)

    Office created. The city hereby creates the position of code enforcement officer to oversee the enforcement of this Code.

    (b)

    Oversight. The code enforcement officer shall report directly to the city manager or his/her designee, and shall be appointed or removed directly by the city manager or designee subject to the Harlem Personnel Policies and Procedures Manual.

    (c)

    Requirements. The code enforcement officer shall not be required to be a sworn police officer by the state. The city manager at his or her discretion shall appoint anyone as code enforcement officer as he or she sees fit whether on a part-time or full-time basis. Educational and training opportunities will be made available and internal policies and procedures shall be developed within community development department subject to the city manager's approval for all matters involving the code enforcement officer.

    (d)

    Goals. The city sets forth that the goal of the code enforcement officer shall be gaining compliance with all provisions of this Code.. However, it is understood that from time to time, the code enforcement officer may have to issue citations which would fall under the jurisdiction of the Harlem Municipal Court as provided by law. No citation shall be issued without direct approval by the city manager.
