§ 106-30. Meetings.

  • (a)

    Regular meetings. Regular meetings of the commission shall be held on the fourth Thursday of the month at 6:30 p.m. at the public safety building, with a minimum of six meetings per year, or in any other designated place, provided the location is specified in all notices required by law.

    (b)

    Called meetings. If a quorum is not present at a regular meeting of the commission, a special meeting shall be held within 14 calendar days from the scheduled meeting.

    (c)

    Continuation of meetings. Nothing herein shall prohibit a continuation of the hearing on an application where the applicant consents.

    (d)

    Quorum. A quorum shall consist of a majority of the commission members.

    (e)

    Decisions of the commission. Decisions of the commission shall be by a majority vote of the members present.

    (f)

    Conduct of meetings. All meetings shall be open to the public. The order of business at regular meetings shall be as follows:

    (1)

    Hearing of continued application;

    (2)

    Hearing of new application;

    (3)

    Reading of minutes of previous meeting;

    (4)

    Old business; and

    (5)

    New business.

    (g)

    Visual compatibility factors.

    (1)

    In reviewing applications for certificates of appropriateness, the commission shall take into account the following visual compatibility factors:

    a.

    Height;

    b.

    Proportion of structure front facade;

    c.

    Proportion of openings within the facade;

    d.

    Rhythm of solids to voids in front facade;

    e.

    Rhythm of structure on streets;

    f.

    Rhythm of entrance and/or porch projection;

    g.

    Relationship of materials and texture;

    h.

    Roof shapes;

    i.

    Walls of continuity;

    j.

    Scale of a building; and

    k.

    Directional expression of front elevation.

    (2)

    The commission may designate more explicit design criteria as it deems necessary. The commission shall not consider the interior arrangement of structures. The commission shall consider the following development standards. An historic structure and any outbuildings related thereto visible from a public street shall only be moved, reconstructed, or altered, in a manner that will preserve the historical and exterior architectural features of the historic structure. For the purpose of this article, exterior architectural features shall include, but not be limited to, the architectural style, scale, general design, and general arrangement of the exterior of the structure, including the kind and texture of the building material, the type and style of all roofs, windows, doors, and signs. In considering proposals for the exterior alterations of historic structures and in applying the development standards, the documented original design of the structure may be considered.

    (h)

    Consideration of applications. Any party may appear in person or by agent or attorney at the meeting. The order of business for consideration of applications for certificates of appropriateness shall be as follows:

    (1)

    The chairperson calls the application by number and address according to the agenda and checks for conflicts of interest among commission members if applicable.

    (2)

    The chairperson calls on the applicant for additional information or comments.

    (3)

    The chairperson calls for other citizens who wish to comment for the record.

    (4)

    The chairperson calls for discussion.

    (5)

    The chairperson calls for motion that application for certificate of appropriateness be approved or denied, or approved subject to conditions, or continued for further information. Second motion. Discussion. Vote.

    (6)

    The chairperson thanks applicant and informs him that he will be mailed the written decision by the commission.

    (i)

    Precedent. No action of the commission shall establish a precedent. Each case shall be decided upon its merits using the ordinance.

    (j)

    Minutes. Minutes shall be taken at each meeting of the commission, noting the vote by each member, those absent so marked. A summary of all pertinent discussions and actions taken by the commission during the course of its public meeting shall be recorded and kept in a well-bound book.
