§ 114-41. Suitability of the land.

  • Land subject to flooding, improper drainage or erosion, and any land deemed unsuitable for development due to wetlands, marshlands, steep slopes, unsuitable soils, subsurface conditions or other undesirable properties, shall not be subjected to development for any uses as may continue such conditions or increase danger to health, safety, life, or property, unless steps are taken to eliminate or abate these conditions. In particular, no land within the delineated 100-year floodplain or within any required watershed protection buffer shall be subdivided for development or included within any lot proposed for subdivision for any development. In addition, no undisturbed buffer that is required by any of the city's development codes and ordinances in order to protect the health, safety and welfare of the community shall be included within any lot proposed for subdivision for any development. Areas deemed unsuitable for development shall not be included in calculations for determining the number of lots that may be included in a subdivision.
